The first count against Penny, manslaughter in the second degree, was dismissed because the jury was deadlocked. Now they'll try to convict him of criminally negligent homicide. It looks like they're not going to let him go. They'll convict him of something and probably put him in prison. Its all because he's white and Neely was black.
